Rules

●  “Applicants” shall mean those persons who fulfill the criteria in the Terms and Conditions.
●  Applicants must apply under the region where they currently reside: if your application is successful then proof of residence will be required.
●  You cannot apply if living outside of Kenya.
●  Applicants can only apply once for Gold and/or Silver and/or Cheza Dimba Award each year.
●  Applicants may apply once a month for the Bronze Award.
●  Applications must be submitted prior to their region’s competition deadline. No late entries will be accepted. See calendar for further information.
●  Applicants must submit a complete application form with correct information together with certified copies of identification documents, any misleading     details  will result in the non-consideration of your application.
● Applicants must provide a valid reference with their up-to-date contact details when applying for the Gold or Silver Awards.
● Only shortlisted Gold and Silver Award applicants will be contacted.
● Cash prizes will only be given for the Bronze Award (Payments made within 21 days of announcement).  
● Gold and Silver awardees will have their products or services purchased and delivered directly by the Company.
● Once goods, products or services have been delivered it is agreed that the winning applicant will take responsibility to ensure these are maintained and used  for their intended use. Failure to do so will result in the awardee’s prize being revoked.
● By applying for the award(s), the applicant acknowledges that he/she has read, understood, and accepted the Terms and Conditions of Tujiamini.

Terms & Conditions

1. DEFINITIONS ANDINTERPRETATION
1.1.   In these Term and Conditions unless the context otherwise requires:
1.1.1. ‘Applicant’ means a person who registers to take part in the Tujiamini initiative.
1.1.2.  ‘Award’ means the gold, silver or bronze award which shall be rewarded to winning participant(s) in the Tujiamini initiative.
1.1.3.  ‘Company' means Milestone Games Limited
1.1.4. ‘Participant’ means a person or group of persons who successfully registers to take part in the Tujiamini initiative.
1.1.5. ‘Tujiamini’ means the initiative created by the Company to identify and nurture sporting talent in Kenya. For the avoidance of doubt this definition includes any successor/future format of this initiative.
1.1.6. ‘Winner’ means a participant(s) who is declared the winner of an Award in the Tujiamini initiative.
1.2.  In these Term and Conditions, unless the context otherwise requires, any reference to:
1.2.1. words importing singular, shall include the plural and vice versa.
1.2.2. a person includes reference to a body corporate or other legal entity.
1.2.3. any written law includes that law as amended or re-enacted from time to time.
1.2.4. Recitals, Sections, Clauses, and Schedules are to Recitals, Sections, Clauses of and Schedules to these Terms and Conditions.
1.2.5. any party includes that party’s successors and assigns; and
1.2.6. headings and table of contents used in these Terms and Conditions are for reference only and shall not affect the interpretation of these Terms and Conditions in any way. The identification of certain breaches in these Terms and Conditions as being “Material” does not indicate that only those breaches are material.

2. Age
2.1.  You can only apply if:
a)    you are 18 years or over on the day of entry.
b)    by submitting, a certified form of Identification (National ID, or Passport) in the application process to confirm your Name, Date of Birth and ID number.
c)    the order of your name in the application matches that on your National ID, or Passport.
2.2.  All Cheza Dimba applications must come from senior teams playing in the Regional Leagues or below. A team is considered a senior team if it has          achieved the top 3 positions in any of the regional Leagues in the last three years preceding the award.

3. Residency
3.1.  At the time of the application, the applicant must be a resident in Kenya and provide proof of the said residency.
3.2.  The proof of residency shall be by provision of a current utility bill, lease and or title deed.
3.3  The Company reserves the right to conduct its own due diligence and confirm the authenticity of residency of any applicant in Kenya.  

4. Application
4.1.  All the required details in the application forms must be completed in FULL.
4.2.  Applicants must submit all correct information, any information provided and found to be misleading will result in the non-consideration of your application.
4.3.  Applicants must provide a valid reference with their up-to-date contact details when applying for Gold or Silver Awards.
4.4.  Applications must be submitted prior to your region’s competition deadline. No late entries will be accepted.  
4.5.  You are only allowed to apply for the Gold and/or Silver Award and Cheza Dimba once per year.
4.6.  You are only allowed to apply for one Bronze Award per month.
4.7.  The Company reserves the right to decline an application for any reason. 

5. Winners
5.1.  Applicants will be required to provide accurate and up-to-date contact details during the competition entry process. The Company will use the contact details provided for communication regarding the competition, including notifications of winning.
5.2.  Participants are responsible for monitoring their provided contact details and responding promptly to any communications. The Company shall not be responsible for any consequences resulting from inaccurate or outdated contact information.
5.3.  Participants may update their contact details by following the instructions provided on the competition website or by contacting the designated support contact.
5.4.  The Company’s representatives will carry out due diligence on all shortlisted applications for Gold and Silver Awards. Failure to comply with the lawful directions issued by the Company’s representatives will result in non-consideration of the Applicant’s application. Only winners will be contacted.
5.5.  All goods, products and services under the Gold & Silver Awards will be purchased directly by the Company from identified vetted suppliers. Prizes can be awarded in kind or in cash as seen fit by the company on a case-by-case basis
5.6.  The prize money for all Bronze winners will be paid via Mobile Money, into their respective Bank Accounts, or as provided in the respective application forms.

6. Distribution of all prizes
6.1. All participants, who are natural persons, shortlisted for the gold and silver categories must provide valid proof of being over the age of 18 years old prior to being officially pronounced winners. The Participant must furnish a duly certified national identification card or passport for verification of their age. Failure to provide satisfactory proof of age will result in disqualification, and an alternate winner may be selected.
6.2.  All prizes and awards won through the Tujiamini initiative will be delivered to their respective winners once the prizes/awards are secured by the Company. The Prizes will be delivered to the address indicated in the winner’s application form.

7. Follow up of Winners.
7.1.  Winners in all categories will be subject to follow ups on the use of prizes and awards and agree to their images being used to promote the Tujiamini campaign after be declared the winner.

8. Prize misuse.
8.1.  All prizes and awards won through the Tujiamini Initiative are to be used in accordance with the needs submitted on the applicant’s/winners’ application form. They cannot be sold or otherwise transferred for monetary gain. Failure to adhere to this will result in legal action.

9. Community Engagement
9.1.  All Gold winners must participate in two (2) community engagements within a year of winning.  This will be arranged, with and by the Company.
9.2.  All Silver winners must participate in one (1) community engagement within a year of winning.  This will be arranged, with and by the Company

.10. Image Rights
10.1.By participating in this campaign, all Applicants hereby grant the Company and its affiliates, subsidiaries, and assigns the unrestricted right to use, reproduce, and distribute their images and likenesses, captured during any promotional and administrative activities related to the competition, for the purpose of promoting and marketing the Campaign. This includes, but is not limited to, the right to display images and likenesses on the company's website, social media channels, promotional materials, and any other marketing platforms, without any further compensation or approval required.
10.2.The Applicants acknowledge and agree that Company shall be the sole and exclusive owner of all rights, title, and interest in and to the images and likenesses, and they waive any right to inspect or approve the finished product or any associated promotional materials. This grant of rights is perpetual, irrevocable, and worldwide.

11. Retraction of Entry
11.1.An applicant can close his/her Account at any time expressly writing the same to the Customer Care Team at care@ke.sportpesa.co.ke
11.2. Application will be limited to one applicant per account. Failure by any applicant to adhere to this rule is a material breach which grants the Company the right to disqualify, terminate, vary or suspend some or all of the Accounts held by the applicant(s) (at its discretion) and take whatever action it reasonably considers appropriate in the circumstances.
11.3. The Company reserves the right to disqualify, terminate, vary or suspend the provision of the Entry, access to Your Account and/or to the Site and/or the App, and refuse any and all current or future entry of the Campaign by You, immediately and without giving You prior notice:

12. Inactive Entries
12.1.Application entries that are submitted with no substantive content, incomplete, or deemed inactive will be considered invalid and may be disqualified from the competition. Participants are reminded to ensure that their application entries contain the required information and materials as specified in the competition guidelines
.12.2.The Company reserves the right to reject, in its sole discretion, any application that does not meet the specified criteria or fails to provide meaningful content. Participants are encouraged to carefully review and adhere to the competition guidelines to ensure the eligibility and validity of their entries.  shall not be responsible for any consequences arising from inactive or empty entries, and such entries may be excluded from consideration without notice.

13. Site Access
13.1.Participantsare responsible for their own access to the competition website. The Company does not guarantee uninterrupted or error-free access to the site and reserves the right to suspend, modify, or terminate access for maintenance, upgrades, or any other reason.

14.  Limitation & Liability
14.1.The Company and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of the participant’s access to, use of, or inability to use the competition, even if advised of the possibility of such damages. Participants acknowledge and agree that their participation is at their own risk. The Company is not responsible for any lost, late, misdirected, or incomplete entries, or for any technical malfunctions that may occur.
